Terms of Service
Last updated October 26, 2026
These terms are an agreement between you and Deposit Recovery (“we”, “us”) for your use of the Deposit Recovery website and app (the “service”). By creating an account or using the service, you agree to them and to our Privacy Policy.
Not a law firm
- Deposit Recovery is a self-help tool. We are not a law firm and we don’t give legal advice.
- We explain New York security deposit law in general terms. You decide what applies to your situation.
- We don’t represent you, negotiate for you, or file anything in court for you. Using the service doesn’t create an attorney-client relationship.
- If your situation is complicated, or your landlord has a lawyer, consider talking to an attorney or a free legal-help organization.
What the service does
The service helps you:
- record the facts of your tenancy and move-out;
- store evidence such as photos, your lease and receipts in a sealed vault;
- track your landlord’s deadlines under New York law (for example, the 14-day deadline to return your deposit or send an itemized statement);
- prepare letters from templates, which you review, edit and send yourself;
- receive your landlord’s replies at a case email address and keep them with your case;
- build a case binder and see general information about small claims court.
The service is designed for residential tenancies in New York State. Some situations, such as rent-controlled apartments, public housing and senior or assisted living, are outside what it can help with; it will tell you if yours is one of them.
Who can use it
You must be at least 18 and able to enter a binding agreement. You may use the service only for your own tenancy, or one you are authorized to act for.
Your account
Keep your sign-in details secure and tell us if you think someone else has used your account. You’re responsible for what happens in your account, including letters approved from it.
Your responsibilities
- The facts you confirm must be true to the best of your knowledge. Letters use them as you confirmed them.
- Review every letter before you send it. Each letter is written in your name and is your communication with your landlord.
- Upload only content you have the right to share, and don’t alter evidence you upload.
- Keep track of your own deadlines and legal rights, including when to go to court.
Letters and sending
- Nothing is sent until you review a letter and press Send. When you do, you authorize us to send that letter, exactly as approved, to the recipients shown.
- Letters are sent from your case email address or, if you connect it, from your Gmail. Gmail access is send-only; see our Privacy Policy.
- Each sent letter is frozen and sealed with a record of what you approved and when.
- We can’t guarantee that an email is delivered, read or answered, or that your landlord will return your deposit.
Automated features
Some features use automated tools, including AI, to read your lease, your landlord’s emails and their statements, and to suggest details or labels. These suggestions can be wrong. They don’t become facts in your case until you confirm them, and you should check them against the original documents. AI doesn’t write your letters.
Deadlines and reminders
We calculate deadlines from the facts you confirm and the law as we understand it, and remind you about them. Wrong or missing facts lead to wrong deadlines, and the law can change. Deadlines and reminders are a help, not a guarantee, and you remain responsible for acting in time.
Your content and evidence
- Your content stays yours. You give us permission to store, process and display it, and to send it as you direct, only to provide the service to you.
- Evidence and timeline entries are sealed when recorded: they can’t be edited, by you or by us. You can delete any file, or your whole account, at any time; deleted evidence can’t be recovered or used later.
- We record when files were uploaded and fingerprint them, but whether a court accepts your evidence is up to the court.
Acceptable use
Don’t use the service to:
- harass, threaten or mislead anyone, including your landlord;
- send false statements or forged documents;
- impersonate someone or act for a tenancy you’re not authorized to act for;
- upload malware or try to break into, overload or reverse-engineer the service;
- break the law.
Fees
If the service or part of it is paid, we’ll show the price before you pay. You won’t be charged for anything you didn’t agree to.
Other services
The service relies on others, such as Google for sign-in and Gmail sending, and email providers for delivery. Your use of those services is also subject to their terms. We aren’t responsible for their outages or changes.
Disclaimers
The service, including its general legal information, is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including that the service will be uninterrupted or error-free, or that it will produce any particular result in your dispute.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or for the outcome of your dispute with your landlord. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Nothing in these terms limits liability that can’t be limited by law.
Ending your use
You can stop using the service and ask us to close your account at any time. We may suspend or close accounts that break these terms or put others at risk. Sealed records are kept as described in our Privacy Policy, and these terms continue to apply to them.
Governing law
These terms are governed by the laws of the State of New York. Disputes about them will be heard in the state or federal courts in New York County, New York, unless the law gives you the right to bring a claim elsewhere, including small claims court.
Changes to these terms
We may update these terms. We’ll change the date at the top and, for significant changes, tell you by email or in the app before they take effect. Continuing to use the service after that means you accept the new terms.
